Two days after it asked a court to stay an order vacating new hours-of-service rules for truck drivers, the Federal Motor Carrier Safety Administration on Wednesday gave advanced notice of a proposed rule focusing on using electronic onboard recorders to improve HOS compliance.

September 1, 2004Government Asks Court to Stay Decision on HOS Rules
The Department of Justice on Monday filed a motion asking a federal court to stay for at least six more months its earlier reversal of the new hours-of-service rules for truck drivers that took effect in January, according to court documents.

The Federal Motor Carrier Safety Administration has filed a motion with the U.S. Court of Appeals for the District of Columbia Circuit seeking to stay further action in Public Citizen Et. Al v. Federal Motor Carrier Safety Administration. Staying the court's decision would allow the agency time to address and to correct the concerns of the court about the new hours-of-service rule.
