The court agreed to take up a case from Boulder, Colo., among a series of lawsuits alleging the companies deceived the public about how fossil fuels contribute to climate change.

Colorado Gov. Jared Polis called it a case of “crossed wires,” saying the state has “finished the investigation and we are conducting a final review of the findings."

Texas, South Dakota, Colorado and Washington were sent letters Oct. 23 by FMCSA Chief Counsel Jesse Elison detailing preliminary determinations of noncompliance.
