Texas, South Dakota, Colorado and Washington were sent letters Oct. 23 by FMCSA Chief Counsel Jesse Elison detailing preliminary determinations of noncompliance.

An FMCSA audit recently found compliance issues in California, Colorado, Pennsylvania, South Dakota, Texas and Washington. South Dakota was first to acknowledge them.

The group claims that FHWA ran afoul of its authority by blocking the funds, which were approved by Congress as part of the Infrastructure Investment and Jobs Act of 2021.
