A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled Jan. 16 that the Department of Transportation had acted 鈥渁rbitrarily and capriciously鈥 when it failed to study the environmental impact of the Bush administration decision to open the country to Mexican trucks.
A Department of Justice spokesman said Jan. 22 there was a possibility Justice could appeal the case to the high court for review.
