Labor Dept. Asks Dismissal of Ergonomics Lawsuit

The overturning of the Occupational Safety and Health Administration’s controversial ergonomics rules should also signal the end to a lawsuit seeking to block the rules, the U.S. Department of Labor argued last week in a court petition.

DOL asked the U.S. Court of Appeals for the District of Columbia to dismiss the lawsuit, saying the case has been rendered moot by Congress’ resolution of disapproval, signed by President Bush March 20.
