American Trucking Associations intends to file a lawsuit in the U.S. Court of Appeals for the District of Columbia asking that trucking be exempted from the government’s new workplace safety rules.

The federation notified the court Dec. 29 that it would pursue legal action against the ergonomics rules that the Occupational Health and Safety Administration issued Nov. 14.

OSHA has exempted construction, agriculture, maritime and railroads from the rules because workers in these industries are subjected to a variety of conditions and a number of work sites.

ATA said it deserves an exemption for these reasons as well, said Robert Digges, deputy chief counsel. Truck drivers usually have no control over working conditions at loading docks and can work under many conditions, he said Jan. 4.
