The California Trucking Association and other industry trade groups have filed a lawsuit to reverse California’s decision labeling diesel particulates a toxic air contaminant.

CTA filed the suit to fight back against a new wave of stringent emissions regulations confronting California carriers at the regional, county and local levels in the wake of the 1998 decision by the California Air Resources Board.

The association charges in the suit that CARB’s ruling that diesel particulates are a significant cancer risk factor is based on “junk science” and studies since rejected by the scientific community.

The lawsuit comes after CARB rejected a request by CTA and other groups that, in light of new evidence, it reconsider its listing of diesel particulates as toxic (9-27, p. 4).
