ATA Asked to Sue Oregon on Ton-Mile Tax

Having lost in the court of public opinion, Oregon trucking representatives now want to take their battle against the state鈥檚 weight-distance tax to a real courthouse.

The Oregon Trucking Associations has asked American Trucking Associations to file a lawsuit against the state, charging that the tax system is unconstitutional.

The lawsuit would be modeled after a similar lawsuit that ATA won in Idaho, bringing about the demise of that state鈥檚 weight-distance tax.

鈥淚t鈥檚 not a perfect match because Oregon鈥檚 tax doesn鈥檛 have a distinctive two-tiered system like Idaho鈥檚 did,鈥 said Michael G. Moises, president of OTA. 鈥淏ut doing legal research and talking to ATA attorney鈥檚 we think there鈥檚 more than enough similarity to warrant a lawsuit.鈥
